The US has Simplified the Rules for Obtaining H-1B Work Visas

If you are planning to permanently reside in the US, but want to apply for temporary residence for now, you will need a visa. Before emigrating to the US, an important question arises: what kind of visa should you get? There are different options and each visa has its own characteristics, requirements for obtaining, advantages and restrictions.

Whether it is a TPS document or an H-1B visa, you will need the help of specialists. Many have heard of the first option, but obtaining a visa was difficult until recent time.

What kind of visa is this

The H-1B nonimmigrant visa program allows US employers to temporarily hire foreign workers for positions that require specialized knowledge and a bachelor’s degree or higher in a specific specialty. It may or may not lead to a green card. It all depends on whether you can convince the employer that you are needed during your stay in the US.

What will change

Under the new rules, nonprofits and government organizations are exempt from the annual cap on H-1B visa set by law. Also, students studying on an F-1 visa can now change their visa to an H-1B to avoid problems with legal status when applying for a job.

In addition, the new rule will allow the US Citizenship and Immigration Services (USCIS) to process applications more quickly for most individuals who have already been approved for an H-1B visa. USCIS also now has the authority to conduct audits and impose fines for non-compliance with the program requirements.

Finally, under the revised rules, an entrepreneur creating a technology company in the United States can now be both an employer and a beneficiary of the visa. That is, apply for an H-1B work visa through his own company.
